WPŁYW KODYFIKACJI PRAWA CYWILNEGO NA POZIOM KULTURY PRAWNEJ SPOŁECZEŃSTW

Abstract

Artykuł przedstawia wpływ kodyfikacji prawa cywilnego na poziom kultury prawnej. Pokazuje ten wpływ w wielu wymiarach (aspektach), tj. unifikowanie prawa cywilnego w państwach, roli wybitnych jednostek (prawników w pracach nad kodeksami) i wpływie prawa rzymskiego na ich treść. Prezentuje ważne spory toczone nad kodeksami i wreszcie charakter języka prawnego używanego przez kodyfikatorów.*The paper shows how the codification of civil law influences the level of legal culture in societies. This influence has many different aspects, such as, inter alia, the unification of civil law in individual states, the role of eminent lawyers in the codification works, or the influence of Roman law on the content of the civil law provisions. Further, the paper presents the main disputes over codifications of law and the language of law that the codifiers use in their work. 20
