Abstract

Im silniejsza staje się konieczność realizacji zasady demokratycznego państwa prawnego, tym bardziej zwracać trzeba uwagę na to, jakie powinny być relacje między sędziowską niezawisłością a respektowaniem praw i wolności człowieka. Kompetentni, niezawiśli i bezstronni sędziowie to warunek sine qua non tego, by sądy mogły skutecznie spełniać funkcję strażnika konstytucji i demokratycznego państwa prawa. Wymiar sprawiedliwości uzależniony jest zarówno od tego, jaka jest treść prawa, jak i od postawy sędziego, a ta podlega wpływom określonej kultury prawnej oraz sposobom wartościowania przyjmowanym i aprobowanym w społeczności sędziowskiej. Sędziowie stanowią wyjątkową grupę zawodową, ponieważ jest ona powołana do decydowania o najistotniejszych ludzkich sprawach. I właśnie dlatego każdy, kto staje przed sędzią, musi być przekonany, że reprezentuje on nie tylko najwyższy kunszt prawniczy, ale także najwyższe standardy etyczne. Tym zasadniczym problemom i ich wzajemnym uwarunkowaniom poświęcona jest książka.

The stronger the need to implement the principles of a democratic state of law, the more attention must be paid to what the relationship between judicial independence and respect for human rights and freedoms should be. Competent, independent and impartial judges are the sine qua non for the courts to effectively fulfil their function as custodians of the Constitution and the democratic state of law. The administration of justice depends not only on what the content of the law is, but also on the attitude of the judge, and this attitude is subject to the influence of a given legal culture, as well as the ways of evaluating that are adopted and approved within the judicial community. Judges constitute a unique professional group, due to their being called upon to adjudicate the most crucial human issues. It is precisely for this reason that anyone who stands before a judge must be convinced that he or she represents not only the highest legal artistry, but also the highest ethical standards. These fundamental problems and their interrelationships are the subject of this book.
