EUROPEJSKI NAKAZ DOCHODZENIOWY – PRZEŁOM W DZIEDZINIE EUROPEJSKIEGO ŚCIGANIA KARNEGO?

Abstract

Artykuł charakteryzuje propozycję decyzji ramowej w sprawie europejskiego nakazu dochodzeniowego. Opisana została istota nowego instrumentu, dokładna procedura wystąpienia z nakazem oraz jego wykonanie. Autorka porównuje nowy nakaz z poprzednimi instrumentami współpracy w Unii Europejskiej w sprawach karnych, tłumacząc jego przełomowość w dziedzinie transgranicznego ścigania karnego. W artykule zawarto również opis zagrożeń związanych z nakazem oraz propozycji ulepszenia niektórych rozwiązań decyzji.***The paper presents the Proposal for a Directive of the European Parliament and the Council regarding the European Investigation Order (EIO) in criminal matters. It describes the essence of the new instrument and the procedure of how to move for it, as well as of its execution. The authoress compares the EIO with the existing EU instruments for cooperation in criminal matters, explaining its innovative nature in the field of cross-border criminal prosecution. The risks associated with the order have been identified, followed by some proposals of improvements of certain adopted solutions.
