System rejestracji ukarań za popełnienie wykroczenia

Abstract

W artykule omówiono powszechne systemy rejestracji wykroczeń ze szczególnym uwzględnieniem rejestru wykroczeń przeciwko mieniu. Krytycznie oceniono szeroki katalog przetwarzanych informacji i ograniczenie prawa dostępu osoby figurującej w ewidencji do danych na jej temat. Przedstawiono wnioski dotyczące okresu przetwarzania danych w rejestrze, usuwania z niego informacji w związku z zatarciem ukarania i przyznania dostępu osobie pokrzywdzonej do danych na swój temat i danych sprawcy wykroczenia.The article discusses the common database systems for registration of misdemeanours, with particular focus on the register of misdemeanours against property. Both the catalogue with processed information, as well as the limitation of the right to access to the information by the person listed therein, raised serious concerns. The author offered some proposals regarding the period of processing data in the register, erasure of information in connection with the expungement of penalty and granting access to the aggrieved to its data and the data of the offender.
