Entomofagia w świetle regulacji dotyczących nowej żywności – wybrane aspekty prawne

Abstract

The paper concerns issues related to the determination of the legal framework allowing the use of insects as foodstuffs, securing their safety and the legal aspects of their introduction to the common market. The current legal state of affairs regarding the use of animals is not uniform within the EU. Therefore the amendments to the existing regulations which will come into force as of 1 January 2018 are welcome. They will help to reach conclusive decisions regarding the legal status of the insect intended for human consumption, and to unify food law in this respect.Lo studio si concentra sulle questioni legate al definire il quadro legislativo relativo allo sfruttamento degli insetti per scopi alimentari, al garantire la loro sicurezza e ad aspetti giuridici dell’immissione sul mercato dell’Unione. Lo stato giuridico attuale in materia di immissione in commercio nell’UE di insetti in quanto alimenti non è uniforme. Occorre quindi accogliere con favore cambiamenti introdotti nelle regolazioni in materia di nuovi alimenti, in vigore dal 1 gennaio 2018. Essi permetteranno di chiarire in via definitiva i dubbi concernenti lo status giuridico degli insetti utilizzati a scopo alimentare, il che consentirà a procedere all’unificazione del diritto alimentare in materia.
