Wybrane aspekty eksperymentu medycznego. Uwagi na tle ratyfikacji Europejskiej Konwencji Biomedycznej

Abstract

W niniejszym artykule autor przeprowadził analizę porównawczą przepisów regulujących problematykę eksperymentów medycznych na człowieku, zawartych w Europejskiej Konwencji Biomedycznej oraz w ustawodawstwie polskim. Celem pracy była ocena wpływu ewentualnej ratyfikacji konwencji na uregulowanie warunków dopuszczalności eksperymentu medycznego w prawie polskim. Szczegółowej analizie poddano zagadnienia, które wymagać będą pilnej interwencji ustawodawczej w przypadku ratyfikacji Konwencji. Chodzi tu o sprzeciw osoby niezdolnej do wyrażenia zgody na udział w badaniu naukowym oraz o problematykę eksperymentów badawczych na embrionach in vitro. Artykuł zawiera zwięzłą ocenę projektów ustawowych regulujących procedurę zapłodnienia pozaustrojowego oraz postulaty de lege ferenda w zakresie statusu prawnego embriona ludzkiego przed implantacją.In this article the author conducted a comparative analysis of regulations connected with medical experiments on a human being, provided for in the Convention on Human Rights and Biomedicine and the Polish legislation. The aim of this article was to estimate the impact of possible ratification of the convention on regulating the conditions of legality of medical experiments in the Polish law. The matters which require urgent attention of the legislator if the convention is ratified were discussed in detail. The above refers to the objection of a person incapable of giving consent to participate in the research study and the legality of experiments on in vitro embryos. The paper evaluates the bills connected with the IVF procedure and contains de lege ferenda postulates in the area of legal status of in vitro embryos before their implantation.
