REGUŁY PRAWNE Z PERSPEKTYWY DOCIEKAŃ FILOZOFICZNYCH

Abstract

Celem eseju jest próba odpowiedzi na pytanie, czy analizy „kierowania się regułą”, zawarte w Dociekaniach filozoficznych Ludwiga Wittgensteina, mogą być interesujące dla filozofii prawa. W pierwszej części artykułu autorzy przedstawili własną interpretację Wittgensteinowskich uwag o kierowaniu się regułą. W części drugiej poczynione ustalenia skonfrontowali z różnymi koncepcjami prawa (Holmesa, Petrażyckiego i Harta), konkludując, że perspektywa zaproponowana w Dociekaniach filozoficznych pozwala na wyjaśnienie różnorodności definicji prawa. W części trzeciej artykułu podjęto próbę obalenia tezy, że Wittgenstein nie mówi nic o normach prawnych.The authors aim to answer the question whether the analysis of the ‘‘rule-following’’ proposed by Ludwig Wittgenstein in his Philosophical Investigations may be of any use for legal philosophy. In the first part of the paper they present their own interpretation of Wittgenstein’s remarks. In the second part they analyse various conceptions of law (including those of Holmes, Petraz˙ycki and Hart) and conclude that the perspective offered by Wittgenstein helps to explain the diversity of the definitions of law. In the third part they make an attempt to reject the thesis that Wittgenstein says nothing of legal norms.
