Wybrane aspekty prawne zagospodarowania pozostałości poprodukcyjnych z wielkotowarowych ferm zwierząt gospodarskich w Polsce

Abstract

The technological progress and growing demand for food are conducive to the devel-opment of industrial agriculture. The impact of industrial agriculture on the environment is much greater than that caused by traditional agriculture. Major dangers come from post-production residue. More precisely, they are animal faeces. The author of this paper made an attempt to categorise animal faeces. The question asked was whether they belong to the category ‘wastage’ or ‘by-products’. Another issue discussed was proper management and utilisation of animal faeces and an assessment of the existing legal regulations to establish whether they guarantee satisfactory protection of the natural environment against the negative impact of intensive animal production. It has been found that the current legislation on the matter researched is not satisfactory and requires amendments. Suggestions as what is needed to better protect the environment have been formulated.Il progresso tecnologico e il crescente fabbisogno alimentare favoriscono lo sviluppo di agricoltura industriale. Essa incide sull’ambiente in misura molto maggiore rispetto all’agricoltura tradizionale. Il principale pericolo è legato ad una notevole quantità di residui di produzione, principalmente sotto forma di deiezioni solide e liquide. L’obiettivo delle considerazioni è un tentativo qualificarli alla categoria di “rifiuti” oppure a quella di “sottoprodotti”, di indicare metodi adeguati di gestione, ed anche di valutare se le regolazioni giuridiche in vigore in Polonia permettano di salvaguardare completamente l’ambiente contro gli effetti negativi di una produzione intensiva di animali. Nella parte conclusiva l’autrice afferma che le regolazioni in esame non proteggono – nell’ambito preso in considerazione – l’ambiente ed indica la direzione dei cambiamenti necessari.
