Abstract

W artykule przedstawiono zarys relacji pomiędzy prawem antymonopolowym Stanów Zjednoczonych a działalnością sportową. Autor zwraca uwagę na napięcie istniejące pomiędzy sportem a interwencją antymonopolową. Podkreśla, że rywalizacja sportowa, zwłaszcza na profesjonalnym poziomie, musi być w jakiś sposób zorganizowana. Regulacje dotyczące organizacji sportu często ograniczają konkurencję i stanowią naturalny przedmiot zainteresowania prawa antymonopolowego. W pierwszym punkcie artykułu wskazano na przepisy antymonopolowe mające zastosowanie do sportu. Następnie przedstawiono koncepcję antymonopolowego zwolnienia baseballu, zarysowano generalne zasady zastosowania prawa antymonopolowego Stanów Zjednoczonych do sportów innych niż baseball, konstrukcję pozaustawowego zwolnienia układów zbiorowych oraz koncepcję obrony single entity. Zbadano również zagadnienie stosunków istniejących pomiędzy prawem antymonopolowym a sportem amatorskim. Autor dochodzi do wniosku, że w systemie prawnym Stanów Zjednoczonych występuje tendencja do systematycznego poszerzania zakresu interwencji antymonopolowej do sportu. Zjawisku temu towarzyszy jednak duża ostrożność sądów w stosowaniu ustawy Shermana w przypadkach, w których zarysowuje się niebezpieczeństwo wywołania zaburzeń w działalności sportowej. W podsumowaniu wskazano również, że unijna judykatura powinna korzystać z doświadczeń amerykańskich.
The paper analyses the relationships between sports activity and antitrust law in the United States antitrust law. It focuses on the tension existing between sport and antitrust. Each sport, and professional sport in particular, must be organised in some way, but the rules concerning the organisation of sports events often limit competition and are therefore a natural subject of interest of antitrust law. The first part of the paper describes the antitrust legal regulation which may be applied to sport. In this context the baseball antitrust exemption is discussed and general rules of application of antitrust law to sports other than baseball are presented. The meaning of the notion of non-statutory labour exemption and the issue of a single entity defence is also mentioned. Finally, the relationship between antitrust and amateur sport is analysed. The U.S. legal system tends to favour a wider application of antitrust law to sports. At the same time US courts are aware that too far-reaching intervention of antitrust law may disturb sports activity.
