Abstract
Z treści analizowanego w artykule orzecznictwa wynika, że problemy, z którymi przyszło się zmagać Trybunałowi, to przede wszystkim kwestie związane z manifestowaniem religii poprzez specyficzny ubiór, a także sprawy wynikające z niezbyt precyzyjnego prawa wyznaniowego w niektórych państwach byłego obozu socjalistycznego. Rzuca się przy tym w oczy fakt, iż kultura prawna urzędników w tychże państwach, a także niestety sędziów, nie pozostaje na szczególnie wysokim poziomie. Koniecznym jest – jak się wydaje – także zapoznanie się ustawodawcy ze standardami prawnymi państwa Europy Zachodniej. Wyraźnie przy tym można dostrzec pewne uprzedzenia w odniesieniu do niektórych ugrupowań religijnych.
After the analysis of judicial decisions the paper refers to a conclusion can be drawn that the problems tackled by the Court mainly concern the issues of manifesting one’s religion via special clothes, and the cases resulting from the insufficiently detailed religious law in some post-communist states. It is striking that legal culture of officials in these states, including the judges, is far from satisfactory. It seems necessary for the legislative power to become acquainted with legal standards of Western Europe. Some obvious prejudices concerning certain religious groups can also be noted.
