O ZASADZIE BEZPOŚREDNIOŚCI W PERSPEKTYWIE ZMIAN KODEKSU POSTĘPOWANIA KARNEGO

Abstract

Niniejszy artykuł, poświęcony pamięci Prof. dr hab. Tadeusza Nowaka, stanowi powrót do Jego rozważań o wpływie zasady bezpośredniości na model polskiego procesu karnego. Analiza zmian, jakie nastąpiły w czasie obowiązywania Kodeksu postępowania karnego w sposobie inkorporacji tej zasady do systemu prawa karnego procesowego, a także wskazanie na propozycje de lege ferenda zmierzające do ograniczenia zasady bezpośredniości zgłoszone przez Komisję Kodyfikacyjną Prawa Karnego są podstawą ukazania dynamiki w sposobie normatywnego ujęcia tej dyrektywy postępowania. Zmiany, te już dokonane i te dopiero proponowane, wyrażające się w odmiennym ukształtowaniu postępowania dowodowego przed sądem prowadzą do ograniczenia zasady bezpośredniości w procesie karnym i stawiają pytanie o aktualność dotąd formułowanych postulatów wyrażających tę zasadę w jej ujęciu abstrakcyjnym.*This paper, in memory of professor Tadeusz Nowak, is a return to his deliberations on the influence of the principle of directness on the Polish model of criminal proceedings. The dynamics in the manner of a normative approach to this directive is shown based on the analysis of the changes in the manner of incorporation of the principle of directness in the system of the criminal procedural law, and is further confirmed by a reference to the de lege ferenda proposals of the Criminal Law Codification Committee intended to restrict the scope of application of that principle. The already implemented amendments as well as these just recommended have nevertheless the same limiting goal and explicitely express postulates that have been so far discussed in an abstract way.
