Mobbing i przeciwdziałanie temu zjawisku na gruncie kodeksu pracy

Abstract

W artykule przestawiono przesłanki określające instytucję mobbingu w rozumieniu art. 943 § 2 kodeksu pracy. Wskazano formy, jakie mogą przybierać działania mobbingowe. Szczególną uwagę poświęcono konstrukcji ciążącego na pracodawcy obowiązku przeciwdziałania mobbingowi (art. 943 § 1 kodeksu pracy), który zdaje się mieć znaczenie kardynalne, jeżeli chodzi o zapobieganie występowaniu mobbingu w środowisku pracy.The paper presents the features of the institution of mobbing within the meaning of article 943 § 2 of the Labour Code. The forms of mobbing activities are indicated. Special attention is given to the structure of the employer obligation of counteracting mobbing (article 943 § 1 of the Labour Code), which seems to have fundamental significance on the ground of prevention of mobbing in the workplace.
